In the video, the police officer says that he “cannot conclusively” say that what he saw was a gun. Other officers not involved in the incident were asked their opinion, they all concluded that it was a gun. One even acknowledged that even if it were a toy, it’s obvious that he intended to portray a threat with it.
Phoenix police supervisor, Mike Wesley, was called to the scene and still refused to make an arrest.
